County Settles

Santa Fe County has reached a settlement in the case of Martinez v. the
Board of County Commissioners of Santa Fe County et al. and the parties have filed paperwork
dismissing the case with the First Judicial Court today.

Andrew Martinez, a former employee at the Santa Fe County Youth Development Program, filed the
suit in November of 2006, alleging, among other things, that the County defendants had permitted a
hostile work environment with respect to Mr. Martinez and had failed to investigate, prevent and
correct harassment and retaliation directed against him. The lawsuit also alleged that Mr. Martinez
was denied due process and that a conspiracy existed to deprive him of his constitutional rights.

“We are happy that an amicable and early settlement has been reached with Mr. Martinez” said
County Manager Roman Abeyta, “We wish him well in his future endeavors.”

The settlement was reached after several days of facilitated settlement negotiations.  The precise
terms of the settlement are confidential by agreement of the parties.
