Deputies investigated a reported Criminal Sexual Penetration that occurred at above listed address. The 27 yoa femal reported being sexual assulted by the above listed individual. The case is under investigation. The suspect was located and fled on foot from Officers. The suspect was arrested and concealed his ID and was found to be in possession of drug paraphernalia.

Deputies responded to a call of a reckless driver in the Valle Vista Sub-division.  Vehicle was located in the area and a short slow speed pursuit occurred.  Upon vehicle comming to a stop driver (listed above) was taken into custody.  Driver was highly intoxicated and had two small children in the vehicle.

On the above date the victim reported that someone had unlawfully gained entry to his residence through a window. Once inside the suspect rumagged through all the drawers and stole several items of value.

Location of arrest:  Rufina and Camino Vista Aurora, Santa Fe, NM

Suspect:  Elias Nevarez, age 38, Santa Fe, NM

Charged:  DWI, Drivers must be licensed, No Insurance, Open Container, Driving on Roadways laned for traffic

On 7/6/08, suspect was observed travelling east on the sidewalk off of Rufina Road and Camino Vista Aurora.  A traffic stop was conducted with the vehicle during which time it was noted that the suspect had an odor of an alcoholic beverage emitting from his person.  SFST's were administered and signs of impairment were displayed.  Suspect did not have a driver's license nor insurance for the vehicle.  Suspect was arrested and agreed to submit to a breath test in which his BrAC was .09, .09.  Two bottles of beer which were located were inside the vehicle.  Suspect was transported and booked into the Santa Fe County Adult Detention Center.

Location:  unknown residence off of Southfork and Cedar, Santa Fe, NM (Silverado Subdivision)

On 7/5/08 RECC received a call from complaintant who stated that a distraught  female was knocking on his door and stated that she had been raped.  The female did not want to contact police and left the area walking.  Deputy made contact with the female walking in which he noticed that her shirt and pants were torn.  The female who was crying stated that she did not want to file a report and only wanted a ride home.  She was not complying with the deputies.  She was checked my Santa Fe County Medical Personnel.  Victim refused to give any further information. 


0208005743 Death Investigation 07-05-08

Location: 19 Calle Norte, SFNM

On the above date, the above named officer responded to the above location with regard to an unresponsive male hispanic.  Upon arrival officer along with medical personnel began lifesaving efforts.  This continued for sometime to no avail.  The office of the medical investigator responded and there were no signs of foul play.  The cause of death is pending examination from the state OMI.

On the above date the victim went to walk her dog at the above location. When she returned to her vehicle it had been broken in to and the stereo system had been stolen out of it.

On the above date the parent of the above child called our agency to report that her daughter had ran away from home. The daughter left a note stating that she needed time alone.


Case#:  0208005739/ Aggravated DWI, Failure to Yield, Driving while license Revoked/ Date:  07/05/08

Location of arrest:  Airport Road and Calle PoAePi, Santa Fe, NM

Suspect:  Aaron A. Rubio, age 20, Santa Fe, NM

Charged:  Aggravated DWI, Failure to yield, Driving while license revoked, Open Containers

On 7/5/08 a traffic stop was conducted as it was observed traveling southbound on Calle PoAePi and failed to yield to the posted stop sign before crossing over Airport Road and entering 4680 Airport Road.  Upon making contact with driver, he displayed signs of impairment and submitted to SFST's in which further signs of impairment were displayed.  Suspect was taken into custody and submitted to a breath test to determine his BrAC which were .19, .18.  Suspect was also found to have his license revoked.  An open can of Tecate beer was located in the center console.  Suspect was then transported and booked into the Santa Fe County Adult Detention Center.

Location of arrest:  64 Camino de Jacobo, Santa Fe, NM (off Airport Road)

Suspect:  Charles A. Montoya, age 38, Santa Fe, NM

Charged:  Bench warrant out of Santa Fe Magistrate Court for failure to pay fines, failure to complete community service and alcohol treatment and a second warrant out of Santa Fe Magistrate Court for driving on a suspended/revoked driver's license and resisting, evading or obstructing an officer.

On 7/4/08 deputies were dispatched to the above stated area in reference to a call of a man with a gun.  Deputies arrived on scene and located the suspect at a different residence and it was determined that the suspect was only intoxicated and did not threaten anyone.  Suspect had 2 different Magistrate Court warrants.  One was for failure to pay fines and complete community service and alcohol treatment.  The second was for driving on suspended/revoked driver's license and resisting, evading or obstructing an officer.  Suspect was arrested, transported and booked into the Santa Fe County Adult Detention Center.
